[Usage -- Personal]

+ Commissions unless otherwise agreed upon are for PERSONAL USE only and all pricing is in USD$. Please read ahead to the next section for commercial information. 

Personal use includes:
-Posting/general sharing on socials/streaming/videos/icons (with attribution)

-Creating your own personal merch for YOURSELF (personal collection), and a small number of close friends and family (birthday, wedding)

-Artwork cropping, outlining, or overlaying with text/emojis/memes are fine if you're making personal graphics and/or merch

-Recoloring/altering poses/painting or drawing over/defacing/etc is prohibited

-Inputting artwork through Artificial Intelligence/Language Learning Models [otherwise known as AI and LLMs respectively] (like Midjourney, Dall-E, Meta AI, Grok, Chat GPT, Claude, Gemini, etc) is prohibited.
-NFT/Crypto/Memecoin/etc use is prohibited.

+Commissioners who wish to keep their commissions perpetually private are subject to a fee of +$50.
(This includes privacy from public sharing on socials and public portfolio only.)

+I retain the rights to completed works unless the commissioner commits to a buyout of rights.

+ Commissions will be posted publicly (socials, portfolios, streaming, etc)  unless otherwise requested, be it temporarily, perpetually, due to signing a Non-disclosure Agreement (AKA an NDA), or if the commissioner has purchased a full transfer of copyright and has otherwise restricted me from doing so.

[Usage -- Commercial/Rights Buyout]

+ Commercial use is available and subject to an additional fee.

Please note, the fees below are for commissioners who's business revenue is under $100,000.
If your revenue is over this amount, please send an e-mail to gomooink@gmail.com with Commercial Inquiry as the title. Please tell me a little about yourself, your project and have a creative brief ready along with your budget.

Fees broken down are as follows:
[Base Price] -- Includes Personal Use (see above) 

[Base Price + 100%] -- Commercial Use: for purposes of generating or supporting revenue like ads, ad revenue, promotions, sponsorship, donation, business logo and/or mascots, thumbnails, brand deals. Does NOT Include Merchandising Rights

[Base Price + 300%] -- Merchandising Rights: for purposes of producing digital goods for sale like ebooks and emotes as well as printed media, printed books, prints, posters, keychains, stickers, pins, etc. Includes Commercial Use

[1000% of Base Cost] -- Complete Buyout of All Rights.

+ Note: Commissioners will not claim themselves as the artist of the completed works (unless under rights buyout) nor contribute works to or allow art to be altered by AI/LLMs. However, artist attribution is not required under rights buyout.

+ If the client previously purchased a personal use commission and now wants to commercialize it or use the work for merchandising purposes, the fees will be based upon the initial price the work was charged as listed on the invoice.

[Selection]

+There is a maximum of 2 Commission projects per Client at any one time.

For example: 2 Sets of Character Commissions, One Character Commission and One Merch Commission

+ You will be contacted via email when I am ready to begin your commission! When I am ready to start, you will be emailed an invoice via Square. CashApp is available as a payment method for the invoice. I can also accept Venmo and Zelle as secondary alternative payments. Paypal is a last resort option and is subjected to a 10% fee. 

+ The Commissioner shall provide as much detail and information as possible relating to their commission. This includes reference images, informational text (because I like reading about people/characters' personalities!), and due date, if applicable.

+ I have the right to refuse service for any reason.

[Process and Completion]

+ Depending on the commission, works may take between 6-8 weeks to complete from the start date. This takes into account the amount of time it takes to communicate between myself and the commissioner, any changes requested by the commissioner, and any possible unforeseen circumstances.

+ Commissioners can expect an email once a week (every Friday) from me regarding the status of their commission. Sundays and Mondays are my "off" days, so please do not expect responses on these two days fo the week

+ Please note that I will not accept commissions that require a week turnaround or less. Commissions that require 2 week or less turnaround will incur a fee of +300% of the total cost.

+ If I am unable to complete a commission for any reason, I will reach out to the commissioner and notify the client beforehand and initiate the steps required to provide a refund. 

+ The Commissioner is entitled to 2 small edits (color tweak, minor expression change, things of that nature) after the completion of the commission. Large edits/edits after the initial 2 will incur a fee of 50% of the grand total cost for every additional inquiry.

[Payment]

+ Payment is via invoice in USD, which will be emailed to the client after contact for commission confirmation. 

+ The Commissioner's Payment is due 100% upfront. I will not begin work until the payment is complete. Please have payment ready. If payment is not sent within 48 hours, your project will be cancelled.

+ 50/50 Payment Plans are available for those that request it so as long as the project is totaled more than $500 for personal commissions and $1000 for commercial use commissions for businesses who's revenues are under $100,000.

50/50 Payment Plans
-The initial 50% of total payment is due up front. This is non-refundable and covers the ideation, drafting, and sketching portions of the process.

-The last 50% will be required before the lineart portion of the process begins. Once received I will continue working on the rest of the commission until completion. Again, this is non-refundable.

-Commissions will be considered abandoned if the Commissioner fails to notify me in a delay in payment after 7 days. 

-There is a 5% late daily fee for late payments.
>(EX: 3 Days late on your $250 payment = $37.50 late fee.)

[Cancellation & Refunds]

+ Refunds are only granted if I have reached out to the commissioner due to being unable to complete the commission due to unforeseen circumstances on my end.

+Refunds are determined based on the progress made on the project.

+ Commissioners who cancel projects are ineligible for a refund

 + 100% kill fee for cancelled and abandoned projects. If 50/50 payment plan then I require the entirety of the project to be paid for.

By commissioning me you agree to these terms as stated above.
